Strat-Tech, Inc. License

This license governs use of the accompanying Web Site. If you use the Web Site, you accept this license. If you do not accept the license, do not use the Web Site.

1. Definitions

The terms “reproduce,” “reproduction” and “distribution” have the same meaning here as under U.S. copyright law.

“You” means the licensee of the Web Site.

“Licensed patents” means any Strat-Tech, Inc. patent claims which read directly on the Web Site as distributed by Strat-Tech, Inc. under this license.

2. Grant of Rights

(A) Copyright - 2008-2010 All rights reserved. Subject to the terms of this license, including the license conditions and limitations in section 3, you may use the public web site information for personal use free and business use if a royalty is paid to Strat-Tech, Inc. For the private web applications such as Fishing Expert or Calorie Counter Expert see 3(E) below.

3. Conditions and Limitations

(A) No Trademark License- This license does not grant you any rights to use Strat-Tech, Inc.’s name, logo, or trademarks.

(B) If you begin patent litigation against Strat-Tech, Inc. over patents that you think may apply to the Web Site (including a cross-claim or counterclaim in a lawsuit), your license to the Web Site ends automatically.

(C) If you distribute copies or link to the Web Site or derivative works, you must retain all copyright, patent, trademark, and attribution notices that are present in the Web Site.

(D) The Web Site is licensed “as-is.” You bear the risk of using it. Strat-Tech, Inc. gives no express warranties, guarantees or conditions. You may have additional consumer rights under your local laws which this license cannot change. To the extent permitted under your local laws, Strat-Tech, Inc. excludes the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

(E) Web Applications such as the Fishing Expert or Calorie Counter Expert that you login to are for use by one purchaser at time and may be shared amongst an immediate family. Any ID and password must be safeguarded and Strat-Tech, Inc. reserves the right to cancel the password if exorbitant usage occurs from too many people using the id and password. The web site may on occasion be down for maintenance procedures and Strat-Tech, Inc. does not assume any liability for not being able to use it.

Generic Ids issued for larger groups such as schools, hospitals, etc. must similarly be protected and may be changed yearly or on a schedule to protect proper usage.
